Terms and Conditions (B2C)

1. Scope

These Terms and Conditions apply to orders placed by private customers (B2C) through the Swiss Dental Wellness online store at www.swissdentalwellness.ch .

Orders placed through an approved business customer account or as part of a relationship expressly designated as B2B may be subject to separate B2B terms and conditions.

Consumers also benefit from any mandatory consumer protection provisions of the country in which they habitually reside, to the extent that such provisions apply to the relevant order.

Any terms and conditions submitted by the customer will not apply unless we have expressly agreed to them.

3. Customer accounts & eligibility to order

When using a customer account, you must provide complete and accurate information. Login details must be kept confidential and must not be disclosed to unauthorised third parties.

Where statutory age requirements apply to particular products or payment methods, such orders may only be placed by persons who meet those requirements.

4. Offers, product presentation & conclusion of the contract

Products displayed in the online store generally constitute an invitation to place an order. Product images are provided for illustrative purposes. Minor differences may occur due to screen settings, changes in manufacturer packaging or production batches, provided that the essential characteristics of the product are not affected.

By submitting an order, you make a binding offer to enter into a purchase contract for the selected products.

An automatically generated confirmation that we have received your order, or that a payment has been received or authorised, does not in itself constitute acceptance of the order unless the relevant confirmation expressly states otherwise.

The contract is concluded when we expressly accept your order, send a shipping confirmation or otherwise clearly confirm acceptance.

We may reject or cancel an order before accepting it where there is an objective reason to do so, including obvious pricing or system errors, lack of availability, failed payment or a reasonable suspicion of fraud or misuse.

Any payment already made in respect of an order that is not accepted will be refunded.

5. Prices, currencies, taxes, customs & shipping charges

The prices and currencies available for the relevant delivery country are displayed in the online store and at checkout. The total amount shown at checkout at the time the order is placed is decisive.

Before the order is completed, applicable product prices, taxes and shipping charges will be displayed to the extent that they are collected or calculated by Swiss Dental Wellness.

Shipping charges may depend in particular on the delivery country, total shipping weight, selected shipping method and order value.

Where a free-shipping threshold applies to a particular market, the corresponding free-shipping option will automatically be displayed at checkout once the applicable conditions have been met.

Current delivery areas, shipping methods, estimated delivery times, weight-based shipping rates and free-shipping thresholds are set out in our Shipping Information.

For cross-border deliveries, additional import VAT, customs duties, customs clearance charges, carrier handling charges or other import-related costs may arise depending on the destination country, order value, type and origin of the goods and the applicable legal requirements.

Unless such duties or charges are expressly shown at checkout as included, prepaid or collected by Swiss Dental Wellness, they are not included in the product or shipping charges collected by Swiss Dental Wellness and may be charged separately to the recipient in the destination country.

Where such costs cannot be calculated in advance, the customer may be required to pay them directly to the relevant authority, shipping carrier or other responsible third party.

Import charges, customs duties, import taxes or clearance fees paid directly to authorities, carriers or other third parties are not automatically included in any subsequent refund issued by Swiss Dental Wellness. Any right to recover such amounts is subject to the applicable customs and tax rules.

This does not apply to amounts collected directly by Swiss Dental Wellness or where reimbursement is required by mandatory law.

We reserve the right to change prices for future orders. Obvious technical or editorial pricing errors may be corrected.

6. Payment methods

The payment methods currently available are displayed at checkout and may vary depending on the delivery country, currency or order value. These may include credit and debit cards, TWINT, PayPal or PostFinance.

By providing payment information, you confirm that you are authorised to use the selected payment method.

Payments may be processed by external payment service providers and may also be subject to their respective terms and privacy policies.

7. Delivery, shipping destinations, delivery times & transfer of risk

We deliver to the countries and regions shown as available for the relevant order in the online store or at checkout.

Available shipping methods and charges may depend in particular on the delivery country, total shipping weight, order value and available shipping method.

The shipping options, shipping charges and estimated delivery times available for the individual order are displayed at checkout. The shipping conditions shown at checkout for the relevant order are decisive.

Where a free-shipping threshold applies to the relevant delivery country, the free-shipping option will automatically be displayed at checkout once the applicable conditions have been met.

Current delivery areas, shipping rates, shipping methods and free-shipping thresholds are set out in our Shipping Information.

Delivery times are generally estimates unless a binding delivery date has expressly been agreed.

The delivery times stated in our Shipping Information generally refer to the estimated transit time after the parcel has been handed over to the carrier. Any stated order processing time may apply in addition.

Delivery is carried out by shipping providers selected by us. For deliveries within Switzerland and to Liechtenstein, Swiss Post may be used in particular.

For consumer orders, the transfer of risk for loss of or damage to the goods is governed by the applicable mandatory legal provisions. Mandatory consumer rights remain unaffected.

Collection from Swiss Dental Wellness, Rigiplatz 1, 8006 Zurich is available only where expressly agreed in advance.

8. Retention of title

To the extent permitted by law, the goods remain our property until payment has been made in full. Mandatory legal provisions remain unaffected.

9. Subscriptions and recurring deliveries

For subscriptions or recurring deliveries, the prices, delivery intervals, renewal terms and cancellation conditions shown for the relevant product and at checkout at the time the contract is concluded will apply.

Where automatic renewal applies, this will be disclosed before the subscription is completed. Cancellation and amendment options are governed by the terms stated for the relevant subscription and by any mandatory statutory rights of the customer.

Discounts or special conditions relating to a subscription apply only where the stated requirements are met.

10. Personalised products & gift cards

For goods made to customer specifications or clearly personalised, a statutory or voluntary cancellation or return right may be excluded to the extent permitted by applicable law.

Rights relating to defective or incorrectly supplied goods remain unaffected.

Gift cards are subject to the terms stated at the time of purchase. Cash redemption is excluded unless mandatory law provides otherwise.

11. Withdrawal, returns, return shipping costs & refunds

For eligible products, we offer a return option within 14 days of receiving the order in accordance with our Returns, Withdrawal and Refund Policy.

For customers residing in Switzerland, where no statutory right of withdrawal applies, this is a voluntary return right offered by Swiss Dental Wellness.

For consumers in the European Union, European Economic Area (EEA) or United Kingdom, all applicable statutory withdrawal, cancellation, refund and other mandatory consumer rights remain unaffected.

For an eligible return made within the applicable 14-day return period, Swiss Dental Wellness will cover the direct cost of standard return shipping, provided that the requirements of our Returns, Withdrawal and Refund Policy are met.

Free return shipping applies to the standard return method provided by Swiss Dental Wellness or otherwise agreed with us. Swiss Dental Wellness determines the appropriate standard return method according to the delivery country and the circumstances of the individual return.

Please contact us before returning goods at info@swissdentalwellness.ch so that we can provide the relevant return instructions and, for international returns where necessary, the applicable customs information.

Where a statutory withdrawal or cancellation right applies, no additional approval from Swiss Dental Wellness is required in order to exercise that right effectively. Prior contact is intended in particular to organise the free return service and ensure correct shipping and customs handling.

Costs arising from an independently selected express, special or otherwise more expensive return method will not be covered unless agreed with us in advance or where reimbursement is required by mandatory law.

For voluntary returns in Switzerland, the original shipping charges are generally not refunded unless the return results from an error by Swiss Dental Wellness or reimbursement is required by law.

Partial returns and orders that originally qualified for free shipping

If an order originally qualified for free shipping because of its original order value and only part of that order is subsequently returned, the original eligibility for free shipping may be reassessed.

If, as a result of a partial return, the value of the products retained by the customer falls below the free-shipping threshold applicable at the time the order was placed, then for voluntary returns and only where permitted by law, the standard shipping charge that would originally have applied to the remaining order may be deducted from the refund.

Any such adjustment will be limited to the standard shipping charge that would have applied to the products retained by the customer under the shipping conditions in force at the time of the original order. No express, Priority or other more expensive shipping charge will be applied retrospectively where such a method would not otherwise have been relevant.

Where a customer exercises a statutory withdrawal or cancellation right, such a recalculation will only be made to the extent permitted by applicable mandatory law. Any mandatory statutory rights of the customer, including any legally required reimbursement of delivery charges, remain unaffected.

The free-shipping thresholds applicable at the time of purchase are set out in our Shipping Information and in the conditions displayed at checkout.

Where applicable law requires reimbursement of the original standard delivery charges following a statutory withdrawal or cancellation, those charges will be refunded in accordance with the relevant legal requirements. Any additional cost resulting from a more expensive delivery method selected by the customer will only be refunded where required by law.

Import charges, customs duties, import taxes or other import and clearance fees paid directly to authorities, shipping providers or other third parties in connection with the original delivery are not part of our free standard return service and are not automatically refunded by Swiss Dental Wellness.

This does not apply to amounts collected directly by Swiss Dental Wellness or where reimbursement is required by mandatory law.

For international returns, the shipping and customs instructions provided by Swiss Dental Wellness must be followed. Where required, the parcel must be identified as returned goods.

Products excluded from our voluntary return right may in particular include opened or used hygiene and personal care products, opened food products, tea blends or supplements, personalised products, custom-made goods and gift cards.

Where a statutory withdrawal or cancellation right applies, only exclusions permitted under the relevant applicable law will apply. These may include sealed goods that are not suitable for return for reasons of health protection or hygiene once the seal has been removed after delivery, as well as goods made to customer specifications or clearly personalised.

Statutory rights relating to defective, damaged, incomplete or incorrectly supplied goods remain unaffected.

To allow us to deal with the matter quickly, we ask that shipping damage or incorrect deliveries be reported, where possible, within 48 hours of receipt by email to info@swissdentalwellness.ch, including the order number and, where possible, photographs or videos.

Failure to report the issue within 48 hours does not affect any mandatory statutory warranty or consumer rights.

12. Warranty & liability

Defects in supplied goods are subject to the applicable statutory warranty provisions and, additionally, to the provisions set out in these Terms and Conditions and our Returns, Withdrawal and Refund Policy.

Mandatory statutory warranty and consumer rights, particularly those applicable because of the customer's habitual residence, are not excluded or restricted by these Terms and Conditions.

To the extent permitted by law, we are not liable for damage resulting from improper use, failure to follow usage instructions, unauthorised modification of a product or circumstances outside our reasonable control.

No limitation of liability applies where liability is mandatory by law, including in cases of intentional misconduct or gross negligence or in any other case where exclusion or limitation of liability is prohibited by law.

13. Intellectual property rights

Texts, images, graphics, designs, logos, trademarks and other content on this website may be protected by copyright, trademark or other intellectual property rights.

Use, reproduction, modification or distribution beyond what is permitted by law is not permitted without the prior consent of the relevant rights holder.

14. Third-party services & external links

Third-party services may be used to operate our online store, including payment, shipping, review, analytics, communications and marketing services.

Use of such services may additionally be subject to the respective provider's terms and privacy policies.

Our website may contain links to external websites. We accept no responsibility for their content or availability except where such responsibility is mandatory by law.

15. Privacy

Information about the processing of personal data in connection with our B2C and B2B activities, including service providers, international data transfers, cookies, analytics and review services, is available in our Privacy Policy.

16. Relationship with our other policies

These Terms and Conditions are supplemented by the relevant policies of Swiss Dental Wellness.

Detailed information about delivery areas, shipping methods, shipping charges, delivery times and free shipping is available in our Shipping Information.

Detailed information about returns, withdrawal and cancellation rights, return shipping, refunds and the treatment of partial returns is available in our Returns, Withdrawal and Refund Policy.

Information about the processing of personal data is available in our Privacy Policy.

If there is any inconsistency between a specific policy and these Terms and Conditions, the more specific provision will generally apply to the matter expressly governed by that policy, unless mandatory law provides otherwise.

17. Changes to these Terms and Conditions

We may amend these Terms and Conditions for future orders where necessary as a result of legal, technical or operational developments.

An order that has already been concluded will generally remain subject to the version in force at the time the contract was concluded, unless mandatory law provides otherwise.

18. Severability

If any provision of these Terms and Conditions is wholly or partly invalid or unenforceable, the remaining provisions will remain unaffected.

The applicable statutory provisions will apply in place of the invalid or unenforceable provision.

19. Applicable law & jurisdiction

Swiss law applies.

For consumers, mandatory protective provisions of the country of their habitual residence remain unaffected where those provisions apply to the contract under the relevant rules of private international law.

Jurisdiction is determined by the applicable legal provisions. Exclusive jurisdiction of the courts of Zurich applies only where such an agreement on jurisdiction is legally permissible.

20. Force majeure and exceptional circumstances

To the extent permitted by law, we are not liable for delays or failure to perform caused by events outside our reasonable control, including natural events, governmental measures, strikes, transport disruptions, customs delays, failures of communications or IT systems or comparable exceptional circumstances.

Mandatory statutory rights of customers remain unaffected.

21. Product information and proper use

Product information, directions for use and warnings must be observed before using a product.

Customers are responsible for using products in accordance with their intended purpose and the manufacturer's instructions.

If there is any uncertainty regarding suitability, use or individual tolerance, appropriate professional advice should be sought before use.

Mandatory statutory liability and warranty rights remain unaffected.
